USER CODE OF CONDUCT

In order to ensure the safety and accessibility of our Game for all users, TIMING CORPORATION has established this User Code of Conduct. By using our Game, users agree to comply with this Code, which sets out the rules and guidelines governing the use of our Game. The Publisher reserves the right to update or modify TIMING CORPORATION’s User Code of Conduct at any time, without prior notice, in order to adapt to legislative or technological developments, or to address new concerns or issues.

Users understand and accept that it is their responsibility to regularly review TIMING CORPORATION’s User Code of Conduct to ensure that their use of our Game complies with the rules in force. In the event of a breach of this Code of Conduct by a TIMING CORPORATION User, the Publisher reserves the right to take appropriate measures, including, without limitation, suspending or terminating the user’s access to the Game, removing any content they have uploaded, posted, used or distributed, and cooperating with judicial authorities if necessary.

1. Complaints and Disputes

Please contact us immediately at contact@absolute-cinema-app.com if you:

(a) have questions, complaints, claims or concerns regarding content appearing in our Game, our Virtual Items, or TIMING CORPORATION in general; or

(b) believe that any act or omission by TIMING CORPORATION or one of our players violates applicable law.

TIMING CORPORATION will then review your request and decide what action to take, and will determine whether another player has, in its opinion, breached these Terms. TIMING CORPORATION will endeavor to inform you of the outcome of this review within a reasonable time after receiving your complaint.

We both acknowledge that Platform providers have no obligation to investigate, settle, defend or resolve any dispute relating to the intellectual property of the Games. The right to report a defect in the Games or Virtual Items expires after three years.

2. User behavior and content

2.1

You must comply with the applicable laws in the place from which you access our Services. If the laws applicable to you prohibit or prevent you from using our Services, you must comply with such restrictions or, where applicable, cease accessing and/or using our Services.

2.2

You warrant that all information you provide to us when accessing and/or using our Services is and remains true, accurate and complete at all times.

2.3

You or another User may send, upload, communicate, transmit or make available, through our Services, information, data, software, sounds, photographs, graphics, videos, tags or other items (“Content”). You understand and accept that responsibility for any Content sent to you when using our Services, whether publicly posted or sent privately, lies solely with the person who sent it. This means that you—and not us—are entirely responsible for the Content you upload, communicate, transmit or make available through our Services.

2.4

You agree not to upload, communicate, transmit or otherwise make available any Content:

  • that is, or could reasonably be considered, illegal, harmful, harassing, defamatory, abusive, obscene or otherwise objectionable;

  • that is or could reasonably be considered an infringement of another person’s privacy;

  • that is likely to incite violence or racial or ethnic hatred, or could reasonably be considered as such;

  • that you do not have the legal right to disclose (such as insider information, information belonging to others, or confidential information);

  • that infringes any intellectual property right or other proprietary right of another person;

  • that consists of any unsolicited or unauthorized advertising, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid schemes” or any other form of solicitation;

  • that contains computer viruses or any other code, file or computer program designed to interrupt, destroy or limit the operation of any software, computer hardware or telecommunications equipment.

    2.5

    You also agree not to:

  • use our Services to mention and/or share private content, social network accounts or any other personal information;

  • use our Services to harm, offend or harass anyone;

  • use another person’s or entity’s email address to register for our Services;

  • use our Services for fraudulent or abusive purposes (including, without limitation, using our Services to impersonate a person or entity, or misrepresenting your affiliation with a person, entity or our Services);

  • conceal, anonymize or mask your IP address or the source of any content you may upload;

  • use our Services for commercial or professional purposes, for the benefit of a third party, or to send unsolicited communications;

  • remove or modify any proprietary right or other information relating to ownership of our Game or any other part of our Services;

  • interfere with or disrupt our Services or the servers or networks that provide our Services;

  • attempt to decompile, reverse engineer, disassemble or hack any of our Services, or circumvent or overcome any encryption technologies or security measures or data transmitted, processed or stored by us;

  • “harvest”, “scrape” or collect any information about other people using our Services, including, without limitation, any data or personal information (including by uploading any element that collects information, including, without limitation, “web beacons”, cookies, graphic interchange formats (“GIFs”) or similar elements sometimes also called “spyware” or “PCM” (passive collection mechanisms));

  • sell, transfer or attempt to sell or transfer an account with us or any part of an account, virtual money and/or virtual goods;

  • disrupt the normal flow of the Game or act in any other way likely to negatively affect other players’ ability to compete fairly when playing our Game or participating in real-time exchanges;

  • disobey any requirements or regulations of any network connected to our Services;

  • use our Services in violation of any applicable law or regulation;

  • use our Services to cheat or design or contribute to cheating (for example, by using automated means, creating multiple accounts or third-party software to play), or to circumvent in any way the technological measures designed to control access to our Services or certain of their elements, or to do anything else that a reasonable person would likely consider contrary to the spirit of fair play or these Terms;

  • use our Services in any other manner not authorized by these Terms.

    2.6

    We do not control Content posted by other users and do not guarantee its accuracy, quality or integrity. You understand that by using our Services, you may be exposed to Content that you consider offensive, indecent or shocking. We will not, under any circumstances, be liable for Content, including any errors or omissions it may contain, or for any loss or damage of any kind resulting from the use of any Content posted, emailed, transmitted or otherwise made available through our Services.

    2.7

    We reserve the right to remove any Content uploaded to our Services if we consider, in our sole discretion, that it constitutes a breach of these Terms or is likely to harm our reputation or that of our Services. However, you acknowledge that we do not actively monitor Content posted by users of our Services and that we do not undertake to do so.

    2.8

    You are solely responsible for your interactions with other Users.

    3. Playing with other users

    3.1

    Our Game allows you to compete against an opponent. In particular, you may:

    choose an opponent or be assigned one by TIMING CORPORATION;

    play against or with one of your contacts on a platform or social network with which you have authorized our Game to interact. Our Game allows you to search your contacts in order to compete against them or play with them. We may also display the nicknames of your previous opponents so that you can find them easily.

    3.2

    When TIMING CORPORATION selects an opponent for you, we may either select at random or use criteria we deem appropriate to select your opponent.

    3.3

    By accessing and/or playing our Game, you agree that your display name, your scores, your avatar, your country of location, your online/offline status and other related details may be displayed on all media (existing or future), for any purpose, in perpetuity, without any payment to you, including (without limitation) to other Users of our Game or as part of our marketing.

    4. Breach of the Terms

    4.1

    Without prejudice to any other remedy or provision of these Terms, if we have reason to believe that you are in serious breach of your obligations under these Terms (including through repeated minor breaches), we reserve the right to take one of the following actions, individually or jointly, with or without notice:

    modify your account or certain parts of your account, or suspend and/or terminate your access to our Services;

    modify and/or remove any virtual currency or virtual goods that may be associated with your account;

    reset and/or modify any game progress or any benefits and privileges associated with your account, such as any level or score you have achieved in our Game;

    terminate or suspend your use of the Game (in which case we may share your name and email address and notify third parties, including Platform providers);

    verify your information by requesting certain documents and we may refuse your request to participate in our Game if we consider we have a valid reason to do so.

    4.2

    If you have already been banned for breaching these Terms, you are prohibited from playing our Game. Any existing or future accounts associated with you may also be terminated or suspended.
